THE HAGUE: A group must die told the judges on Monday that Dutch Laws allowing physician-assisted suicide in the Netherlands but criminalizing others who help people take their own lives is a violation of European human rights law and must be declared illegal.
“We believe we can provide the means to be able to take your own life humanely if you want and feel the time has come,” said Jos van Wijk of Last Will Cooperative, who filed the lawsuit. along with 29 plaintiffs against the Dutch State, said in court.
A lawyer for the cooperative said the case was a strategic case aimed at forcing the Netherlands to change the law.
They argue that the current ban on assisted suicide, which is left unattended by medical professionals, violates the right to self-determination and respect for private life enshrined in the European convention on human rights.
The Dutch state considers that the Dutch language euthanasia Lawyer Wemmeke Wisman, representing the Dutch state, said: “There is a careful balance between the state’s obligation to protect the lives of its citizens and the right to self-determination of those facing pain and suffering. unbearable suffering and no hope of recovery”.
The Netherlands is the first country in the world to legalize physician-assisted death and suicide under very strict conditions and under the supervision of medical professionals.
Aiding suicide or providing a means to commit suicide outside of the strict criteria of survival, is punishable by up to three years in prison under Dutch law.
The Last Will Cooperative has advertised a suicide powder it calls “Substance X” since 2018 as a cheap and painless way to die.
There is a separate case going on before a Dutch court against a member of the cooperative who was suspected of aiding unlawful suicide by selling “Substance X” to at least 33 people who subsequently died.
