Husband, father of two, sues Jack in the Box, alleging that staff shot him during a dispute over fries.

HOUSTON – A Houston-area family is suing a fast-food chain after it said a worker pulled a gun and shot them.

The family said they were at a drive-through window through Jack In The Box in March 2021 when they argued with staff about the fries.

“It was scary. It was very, very scary,” said Anthony Ramos.

Ramos said an employee working through the driver’s window opened fire on him, his pregnant wife and their 6-year-old child in the back seat of their car after arguing about the potato dish. fries they paid for.

Attorney Randall Kallinen said: “After paying for their meal, they looked in their bag and didn’t find any fries, and when they asked for the fries, they were denied. .

Ramos’ attorney said one discussion resulted in shouting and ended with the female employee swearing, pulling out a gun and shooting them as Ramos drove away.

“Thank God nothing happened to my family but it could have been worse and that’s unacceptable,” Ramos added.

In suing Jack In The Box, Ramos said he hopes this will require the company to strengthen and perfect the policies and business practices used to legally vet employees.

“They need to hire better people. That’s really what I’m after. To make sure that a situation like this that happens to me and my family never happens again,” Ramos said.

Houston police investigated and arrested the employee for more serious assault with a deadly weapon. She pleaded guilty to a lesser charge of murder.

Jack In The Box told KPRC 2 that it does not comment on ongoing legal matters, particularly those involving independent franchise owners.
